Article 1: DEFINITIONS

CHATEAU ROUGE: this term collectively designates the company LABORATOIRE CHATEAU ROUGE with a capital of €7,700.00, intra-community VAT number: FR34434469474, registered with the Paris R.C.S under number PARISB434469474, whose registered office is located at 60 rue Etienne Dolet, 92240 MALAKOFF.


PRODUCT(S): this term designates the cosmetic products marketed by LABORATOIRE CHATEAU ROUGE and offered for sale on the SITE.


PURCHASER: this term designates the contracting party, a natural person and a non-professional, having ordered one or more PRODUCT(S) on the Site.


SITE: This term refers to the LABORATOIRE CHATEAU ROUGE website: anciensite.chateaurouge.net on which the PRODUCTS are presented and sold to the BUYER. It is hosted by OVH? 2 rue Kellermann - 59100 Roubaix.


ORDER: this term designates the sales contract concluded between CHATEAU ROUGE and the BUYER.
Party(ies): this term designates jointly or separately the BUYER and/or CHATEAU ROUGE

Article 2: PURPOSE

The purpose of these general terms and conditions of sale and guarantees is to define the terms and conditions under which CHATEAU ROUGE offers, via its SITE, the marketing of PRODUCTS to BUYERS.

Consequently, any ORDER of one or more PRODUCTS of the BUYER entails its unreserved acceptance and its prior, full and entire adherence to these general conditions of sale and guarantees which prevail over any other document, except for specific conditions. expressly consented in writing by CHATEAU ROUGE..

The BUYER acknowledges having read the general conditions of sale and guarantees prior to placing their ORDER.

These general conditions of sale only apply to the online sale of PRODUCTS on the SITE.
CHATEAU ROUGE reserves the right to modify these general conditions of sale and guarantees at any time.

Nevertheless, the general conditions of sale and guarantees applicable to the ORDER of PRODUCTS placed by a BUYER on the SITE are those accepted by the BUYER at the time of placing the ORDER.

These general conditions of sale and guarantees supplement the conditions of use of the SITE available at any time in the "Legal notices" section of the SITE and applicable to the BUYER.

Article 3: SPECIFIC PROVISIONS FOR THE SALE OF PRODUCTS ON THE SITE

Article 3.1: Availability of PRODUCTS

In accordance with Article L. 111-1 of the Consumer Code, the BUYER may, prior to his ORDER, find out, directly on the SITE, the essential characteristics of the PRODUCT(s) he wishes to order.

On the other hand, in the event that the BUYER wishes to obtain qualified advice on the PRODUCTS, Customer Service is available to him at the following number: 01.87.42.07.94.


In the event of unavailability of the PRODUCTS after placing the ORDER, the BUYER will be informed as soon as possible. He will then be offered the option of modifying his ORDER or canceling it and thus obtaining a refund within 30 days of his request.

Article 3.2: Ordering PRODUCTS

To purchase the PRODUCTS, the BUYER should connect to the SITE and enter their e-mail address and password or create an account where they must enter their title, surname, first name , email address and password.
An online ORDER of PRODUCTS results in:

  • Firstly: the sending by CHATEAU ROUGE, via e-mail, of a confirmation and summary of the ORDER
  • Secondly: the sending by CHATEAU ROUGE, via e-mail, of a confirmation of shipment of the ORDER
  • Thirdly: delivery by CHATEAU ROUGE of the PRODUCTS, by post, to the address indicated by the BUYER when placing their ORDER for PRODUCTS

Article 3.3: Warranties & After-Sales Service

In any event, the BUYER benefits from the legal guarantee of eviction and hidden defects provided for in articles 1641 of the Civil Code and following.

In the event of non-compliance of the PRODUCTS with the ORDER or delivery of a PRODUCT revealing a latent defect CHATEAU ROUGE undertakes, at the BUYER's choice, either to exchange the PRODUCT for an identical PRODUCT or quality and equivalent price depending on the availability of stock, or to reimburse the price of the PRODUCT within a maximum period of 30 days following the request of the BUYER.


For any complaint,a "PRODUCTS" After-Sales Service is available to the BUYER:

With the exception of the specific case of non-compliance of the PRODUCTS with the ORDER, there is no exchange of PRODUCT possible.

If the BUYER changes his mind and wishes to exchange a PRODUCT ordered for a new PRODUCT, he must, under his right of withdrawal (see article 5.6), return the PRODUCT. This will be refunded but not exchanged.

To have a new PRODUCT, the BUYER must place a new ORDER on chateaurouge.net.

Article 4: PROVISIONS COMMON TO THE SALE OF PRODUCTS ON THE SITE

Article 4.1: Order

An ORDER is deemed to have been placed on the SITE and the general conditions of sale and guarantees accepted once the BUYER has validated his payment.

The data recorded by CHATEAU ROUGE and the secure payment provider constitute proof of the nature, content and date of the ORDER. The double click of the BUYER under the ORDER constitutes an electronic signature which has the same value as a handwritten signature.

The double click and the acceptance of the general conditions of sale and guarantees (checkbox) constitute irrevocable and unreserved acceptance of the ORDER by the BUYER.
The sale will only be considered final after the sending to the BUYER of the confirmation of the ORDER by CHATEAU ROUGE and collection by the latter of the full price.

CHATEAU ROUGE recommends that the BUYER keep the information contained in the ORDER confirmation sent by CHATEAU ROUGE on paper or computer.


Notwithstanding the foregoing, CHATEAU ROUGE reserves the right to cancel any ORDER from a BUYER with whom there is a prior payment dispute or for any other legitimate reason, particularly with regard to the abnormal nature of the COMMAND.


At any time, the BUYER can follow his ORDER in the space "My Account/My Orders" provided for this purpose.

Article 4.2: Price

The prices of the PRODUCTS are expressed in euros and include all taxes (TTC), excluding participation in processing and shipping costs, the fixed amount of which varies according to the weight and destination of the package.


The carrier used is La Poste: Colissimo at home or Colissimo at a collection point.

In the event of an order to a country other than metropolitan France, you are considered to be the importer of the product(s) concerned

Customs duties or other local taxes or import duties or purchase taxes may be required. These rights and sums are not the responsibility of LABORATOIRE CHATEAU ROUGE but are the responsibility of the buyer.

Article 4.3: Payment

Payment for the ORDER is made online on the SITE (chateaurouge.net) via a payment card (credit card, Visa, Mastercard).

In the event of the purchase of one or more PRODUCTS on the SITE, the BUYER indicates directly in the areas provided for this purpose: the card number, its expiry date as well as its control code located on the back of the map.

The entire amount of the ORDER will be debited from the bank card on the day of the ORDER.
CHATEAU ROUGE reserves the right to suspend any management of the ORDER and any delivery in the event of non-payment or refusal of payment. payment authorization by credit card from officially accredited and usual internet organizations.

CHATEAU ROUGE reserves the right to refuse or honor an ORDER from a BUYER who has not paid for all or part of a previous ORDER or with whom a payment dispute remains.


CHATEAU ROUGE cannot be held responsible for any embezzlement or fraudulent use of any means of payment that would not have been detected by the verification procedure. The BUYER guarantees CHATEAU ROUGE that he has the necessary authorizations to use the method of payment he has chosen for his ORDER.

Any fraudulent use of the bank card cannot give rise to reimbursement by CHATEAU ROUGE. As long as an ORDER for PRODUCT(s) has not been fully paid for, the PRODUCT(s) remain(s) the property of CHATEAU ROUGE.

Article 4.4: Securing Payments

Purchases made by the BUYER are secure. When the BUYER places his ORDER online, he is on the CHATEAU ROUGE servers. When the BUYER pays for their ORDER, it switches to the secure servers of the CHATEAU ROUGE partner.


Transactions carried out on the SITE are secured by the Mercanet payment system. All information exchanged to process the payment isencrypted using the SSL protocol.This data cannot be detected, intercepted or used by third parties. Mercanet is certified by Visa (AIS), Mastercard (SDP) and American Express (TDC).

Article 4.5: Shipping & Delivery

Delivery is free from €20 to a pick-up point and €50 for home purchases only for mainland France and Corsica.
CHATEAU ROUGE undertakes to ship the ORDER within 24 hours to 2 working days, depending on the choice of delivery method made by the BUYER.Average delivery times vary depending on the geographical area of ​​delivery:

Metropolitan France: 2 to 5 days / Overseas: 7 to 15 days / International: 7 to 15 days

Delivery is made by COLISSIMO or Chronopost, to the delivery address specified by the BUYER when placing the ORDER CHATEAU ROUGE cannot be held responsible for late delivery due to the carrier.

Any erroneous or missing information in the delivery address and the identity of the BUYER releases CHATEAU ROUGE from responsibility for the delivery.
Upon receipt of the ORDER, the BUYER is required to:

  • To make any reservations and complaints to the post office employee or to refuse the package if it is likely to have been opened or damaged
  • To report these incidents to the After-Sales Service whose contact details are indicated in article 3.3 for PRODUCTS
  • This without delay and at the latest within 7 working days from receipt of the ORDER.

Failing this, the ORDER is deemed delivered in good condition and cannot be the subject of any subsequent dispute.

Article 4.6: Withdrawal & Non-compliance

In application of the provisions of article L.121-20 of the Consumer Code, the BUYER has a withdrawal period of fourteen (14) days from the delivery of his ORDER to return of the PRODUCT(S) delivered for reimbursement.

When the fourteen (14) day period expires on a Saturday, Sunday or a public holiday or non-working day, it is extended until the first following working day.

The refund of all sums paid will take place no later than 30 days from the date of exercise of the right of withdrawal. Beyond that, the amount due is automatically subject to interest at the legal rate in force.

Returns (due to non-compliance or the exercise of the right of withdrawal) must in all cases be made to the following address: LABORATOIRE CHATEAU ROUGE, 60 rue Etienne Dolet, 92240 MALAKOFF, in their packaging original and in perfect resalable condition. In principle, the return postage of the package remains the responsibility of the BUYER.

Article 4.7: Liability

CHATEAU ROUGE cannot be held liable for any consequential damages that may arise from the purchase of the PRODUCTS.
CHATEAU ROUGE cannot be held liable for non-execution of the ORDER in the event of a shortage of stock or unavailability of the PRODUCTS due to a case of force majeure as defined by French case law and courts.

Similarly, CHATEAU ROUGE's liability under the obligations of these general conditions of sale cannot be engaged in the event of the occurrence of damage resulting from the use of the Internet network, such as viruses, intrusion, loss of data, interruption of internet service.

Article 4.8: IT & Freedoms

The information collected by CHATEAU ROUGE during any ORDER by the BUYER is necessary for the processing of ORDERS by CHATEAU ROUGE and its business partners.


In accordance with the Data Protection Act No. 78-17 of January 6, 1978, the BUYER has a right of access, rectification, deletion and opposition to his personal data. The BUYER can exercise this right by writing to

CHATEAU ROUGE may send promotional offers by post or e-mail, in particular the e-newsletter, subject to the prior agreement given by the BUYER as part of the registration procedure

Article 4.9: Intellectual Property

The Website www.chateaurouge.net is an intellectual work protected by Intellectual Property Law. Each of the elements that compose it (such as, in particular, brands, logos, photographs, images, illustrations, texts, slogans, video.) are the exclusive property of CHATEAU ROUGE, which alone is authorized to use the intellectual property rights and the rights of the personality relating thereto.
Any reproduction and/or representation in whole or in part, use, adaptation or modification, of the SITE or of any of the elements that compose it on any medium whatsoever, and in any form whatsoever or, for other purposes and in particular commercial is expressly prohibited.

Any reproduction and/or representation of the SITE or any of its constituent elements must be subject to the express prior authorization of CHATEAU ROUGE. The creation of hypertext links to the SITE can only be carried out with the prior written authorization of CHATEAU ROUGE.

The trademarks mentioned on the SITE are registered and therefore protected trademarks and are the exclusive property of CHATEAU ROUGE.

Article 4.10: Conciliation & Litigation

In the event of a dispute between CHATEAU ROUGE and the BUYER, the most diligent party sends, prior to any referral to a court, a letter of formal notice containing the grievances alleged against the other party .

Failing to implement an attempt at conciliation within 15 days from the date of the letter of formal notice or in the event of failure of the latter, the most diligent of the parties must notify the other party in writing, prior to any referral to a competent court, of the end of the conciliation period.

Article 4.11: Applicable Law & Competent Jurisdiction

These general conditions of sale as well as the sales of CHATEAU ROUGE PRODUCTS are subject to the application of French law.
In the absence of conciliation, any dispute relating to the interpretation, execution or termination of the contract concluded between CHATEAU ROUGE and the BUYER shall be subject to the exclusive jurisdiction of the French courts.
