General Terms and Conditions of Sale

Article 1: DEFINITIONS

CHATEAU ROUGE: this term collectively refers to the company LABORATOIRE CHATEAU ROUGE with a capital of €7,700.00, VAT number: FR34434469474, registered with the Paris Trade and Companies Register under number PARISB434469474, whose registered office is located at 60 rue Etienne Dolet, 92240 MALAKOFF.


PRODUCT(S): this term refers to the cosmetic products marketed by LABORATOIRE CHATEAU ROUGE and offered for sale on the SITE.


BUYER: this term refers to the contracting party, a natural person and non-professional, who has ordered one or more PRODUCT(S) on the Site.


SITE : This term refers to the LABORATOIRE CHATEAU ROUGE website: anciensite.chateaurouge.net where the PRODUCTS are presented and sold to the BUYER. It is hosted by the company OVH, 2 rue Kellermann - 59100 Roubaix.


ORDER : this term refers to the sales contract concluded between CHATEAU ROUGE and the BUYER.
Party(ies): this term refers jointly or separately to the BUYER and/or CHATEAU ROUGE

 

Article 2: PURPOSE

These general terms and conditions of sale and guarantees aim to define the terms and conditions under which CHATEAU ROUGE offers, via its SITE, the marketing of PRODUCTS to BUYERS.

Consequently, any ORDER of one or more PRODUCTS by the BUYER implies their unconditional acceptance and prior, full, and complete adherence to these general terms and conditions of sale and guarantees, which take precedence over any other document, except for specific conditions expressly agreed in writing by CHATEAU ROUGE.

The BUYER acknowledges having read the general terms and conditions of sale and guarantees prior to placing their ORDER.

These general terms and conditions of sale apply only to the online sale of PRODUCTS on the SITE.
CHATEAU ROUGE reserves the right to modify these general terms and conditions of sale and guarantees at any time.

However, the general terms and conditions of sale and guarantees applicable to the ORDER of PRODUCTS placed by a BUYER on the SITE are those accepted by the BUYER at the time the ORDER is placed.

These general terms and conditions of sale and guarantees supplement the SITE's terms of use, which are available at any time under the "Legal Notice" section of the SITE and apply to the BUYER.

 

Article 3: SPECIFIC PROVISIONS FOR THE SALE OF PRODUCTS ON THE SITE

 

Article 3.1: Availability of PRODUCTS

In accordance with Article L. 111-1 of the Consumer Code, the BUYER may, prior to placing their ORDER, directly view on the SITE the essential characteristics of the PRODUCT(S) they wish to order.

Furthermore, if the BUYER wishes to obtain qualified advice on the PRODUCTS, a Customer Service is available at the following number: 01.87.42.07.94.


In the event of PRODUCT unavailability after placing the ORDER, the BUYER will be informed as soon as possible. They will then be offered the choice to modify their ORDER or cancel it and thus obtain a refund within 30 days following their request.

 

Article 3.2: Ordering PRODUCTS

To purchase the PRODUCTS, the BUYER must log in to the SITE and enter their email address and password or create an account where they must provide their title, last name, first name, email address, and password.
An online ORDER of PRODUCTS entails:

  • Firstly: sending by CHATEAU ROUGE, via email, an order confirmation and summary
  • Secondly: sending by CHATEAU ROUGE, via email, a shipping confirmation of the ORDER
  • Thirdly: delivery by CHATEAU ROUGE of the PRODUCTS by postal service to the address indicated by the BUYER when placing their PRODUCT ORDER.

Article 3.3: Guarantees & After-Sales Service

In any case, the BUYER benefits from the legal guarantee against eviction and hidden defects provided for in articles 1641 of the Civil Code and following.

In case of non-compliance of the PRODUCTS with the ORDER or delivery of a PRODUCT revealing a hidden defect, CHATEAU ROUGE commits, at the BUYER’s choice, either to exchange the PRODUCT for an identical PRODUCT or one of equivalent quality and price depending on stock availability, or to refund the PRODUCT price within a maximum of 30 days following the BUYER’s request.


For any complaint, a "PRODUCTS" After-Sales Service is available to the BUYER:

  • Phone: 01.87.42.07.94 (Monday, Tuesday, Thursday, Friday from 10 am to 5 pm)
  • Mail: LABORATOIRE CHATEAU ROUGE, 60 rue Etienne Dolet, 92240 MALAKOFF.

Except in the specific case of non-compliance of the PRODUCTS with the ORDER, no PRODUCT exchange is possible.

If the BUYER changes their mind and wishes to exchange an ordered PRODUCT for a new PRODUCT, they must, under their right of withdrawal (see article 5.6), return the PRODUCT. It will be refunded but not exchanged.

To obtain a new PRODUCT, the BUYER must place a new ORDER on chateaurouge.net.

 

Article 4: COMMON PROVISIONS FOR THE SALE OF PRODUCTS ON THE SITE

 

Article 4.1: Order

An ORDER is considered placed on the SITE and the general terms and conditions of sale and guarantees accepted as soon as the BUYER has validated their payment.

The data recorded by CHATEAU ROUGE and the secure payment provider constitute proof of the nature, content, and date of the ORDER. The BUYER’s double-click for the ORDER constitutes an electronic signature with the same value as a handwritten signature.

Double-clicking and acceptance of the general terms and conditions of sale and guarantees (checkbox) constitute an irrevocable and unconditional acceptance of the ORDER by the BUYER.
The sale will only be considered final after the ORDER confirmation has been sent to the BUYER by CHATEAU ROUGE and full payment has been received.

CHATEAU ROUGE recommends that the BUYER keep the information contained in the ORDER confirmation sent by CHATEAU ROUGE on a paper or electronic document.


Notwithstanding the above, CHATEAU ROUGE reserves the right to cancel any ORDER from a BUYER with whom there is a prior payment dispute or for any other legitimate reason, notably due to the abnormal nature of the ORDER.


At any time, the BUYER can track their ORDER in the "My Account/My Orders" section provided for this purpose.

 

Article 4.2: Price

PRODUCT prices are expressed in euros and include all taxes (TTC), excluding handling and shipping fees, which are a flat rate varying according to the weight and destination of the package.


The carrier used is La Poste: Colissimo home delivery or Colissimo pickup point.

For orders to countries other than mainland France, you are considered the importer of the product(s) concerned.

Customs duties or other local taxes or import duties or purchase taxes may be required. These duties and amounts are not the responsibility of LABORATOIRE CHATEAU ROUGE but are borne by the buyer.

 

Article 4.3: Payment

Payment for the ORDER is made online on the SITE (chateaurouge.net) via a payment card (Carte Bleue, Visa, Mastercard)..

When purchasing one or more PRODUCTS on the SITE, the BUYER directly enters in the designated fields: the card number, its expiration date, and the security code located on the back of the card.

The full amount of the ORDER will be charged to the credit card on the day of the ORDER.
CHATEAU ROUGE reserves the right to suspend any ORDER processing and delivery in case of non-payment or refusal of payment authorization by credit card from officially accredited and usual internet organizations.

CHATEAU ROUGE reserves the right to refuse or fulfill an ORDER from a BUYER who has not paid all or part of a previous ORDER or with whom a payment dispute remains.


CHATEAU ROUGE cannot be held responsible for any fraud or misuse of any payment method that was not detected by the verification procedure. The BUYER guarantees CHATEAU ROUGE that they have the necessary authorizations to use the payment method chosen for their ORDER.

Any fraudulent use of the credit card will not result in a refund by CHATEAU ROUGE. As long as an ORDER for PRODUCT(s) has not been fully paid, the PRODUCT(s) remain the property of CHATEAU ROUGE.

 

Article 4.4: Payment Security

Purchases made by the BUYER are secure. When the BUYER places their ORDER online, they are on CHATEAU ROUGE’s servers. When the BUYER makes the payment for their ORDER, they switch to the secure servers of CHATEAU ROUGE’s partner.


Transactions made on the SITE are secured by the Mercanet payment system. All information exchanged to process the payment is encrypted using the SSL protocol. This data cannot be detected, intercepted, or used by third parties. Mercanet is certified by Visa (AIS), Mastercard (SDP), and American Express (TDC).

These certifications guarantee that the operational processes and technical solutions used by Mercanet meet the highest standards in securing exchanges and protecting banking data. Mercanet is thus among the first payment operators worldwide to offer these three certifications.

 

Article 4.5: Shipping & Delivery

Delivery is free from €20 in relay points and €50 for home delivery only for mainland France and Corsica.
CHATEAU ROUGE commits to shipping the ORDER within 24 hours to 2 business days, depending on the delivery method chosen by the BUYER. Average delivery times vary according to the delivery geographic area:

Mainland France: 2 to 5 days / Overseas: 7 to 15 days / International: 7 to 15 days

Delivery is carried out by COLISSIMO or Chronopost, to the delivery address specified by the BUYER at the time of ORDER. CHATEAU ROUGE cannot be held responsible for delivery delays caused by the carrier.

Any incorrect or missing mention in the delivery address and the BUYER's identity releases CHATEAU ROUGE from delivery responsibility.
Upon receipt of the ORDER, the BUYER is required to:

  • To make all reservations and claims to the postal clerk or to refuse the package if it appears to have been opened or damaged
  • To report these incidents to the After-Sales Service whose contact details are provided in Article 3.3 for the PRODUCTS
  • This must be done without delay and no later than 7 working days from receipt of the ORDER.

Otherwise, the ORDER is deemed delivered in good condition and cannot be subject to any subsequent dispute.

 

Article 4.6: Withdrawal & Non-compliance

In accordance with the provisions of Article L.121-20 of the Consumer Code, the BUYER has a withdrawal period of fourteen (14) full days from the delivery of their ORDER to return the delivered PRODUCT(S) for a refund.

When the fourteen (14) day period expires on a Saturday, Sunday, or public holiday, it is extended until the next business day.

The refund of the full amount paid will be made no later than 30 days from the date of exercising the right of withdrawal. Beyond this period, the amount due will automatically accrue interest at the legal rate in force.

Returns (due to non-compliance or exercising the right of withdrawal) must in all cases be made to the following address: LABORATOIRE CHATEAU ROUGE, 60 rue Etienne Dolet, 92240 MALAKOFF, in their original packaging and in perfect resale condition. In principle, the return shipping costs remain the responsibility of the BUYER.

 

Article 4.7: Liability

CHATEAU ROUGE cannot be held liable for any indirect damages that may arise from the purchase of PRODUCTS.
CHATEAU ROUGE cannot be held responsible for the non-fulfillment of the ORDER in case of stock shortage or unavailability of PRODUCTS due to a force majeure event as defined by French case law and courts.

Similarly, CHATEAU ROUGE’s liability under these general terms and conditions of sale cannot be engaged in the event of damage resulting from the use of the Internet network, such as viruses, intrusion, data loss, or internet service interruption.

 

Article 4.8: Data Protection & Privacy

The information collected by CHATEAU ROUGE during any ORDER by the BUYER is necessary for the processing of ORDERS by CHATEAU ROUGE and its business partners.


In accordance with the Data Protection Act No. 78-17 of January 6, 1978, the BUYER has the right to access, rectify, delete, and object to their personal data. The BUYER can exercise this right by writing to

Laboratoire CHATEAU ROUGE, Customer Service, 60 rue Etienne Dolet, 92240 MALAKOFF, indicating your name, first name, and address as well as the subject of the request.

CHATEAU ROUGE may send promotional offers by postal mail or email, including the e-newsletter, subject to the prior consent given by the BUYER during the registration process.

This site has been registered with the CNIL under number 1791365.

 

Article 4.9: Intellectual Property

The website www.chateaurouge.net is an intellectual work protected by Intellectual Property Law. Each of its components (such as trademarks, logos, photographs, images, illustrations, texts, slogans, videos) is the exclusive property of CHATEAU ROUGE, solely authorized to use the related intellectual property rights and personality rights.
Any full or partial reproduction and/or representation, use, adaptation, or modification of the SITE or any of its components on any medium and in any form for other purposes, especially commercial, is expressly prohibited.

Any reproduction and/or representation of the SITE or any of its components must have the express and prior authorization of CHATEAU ROUGE. The creation of hyperlinks to the SITE can only be done with the prior written authorization of CHATEAU ROUGE.

The trademarks mentioned on the SITE are registered trademarks and therefore protected, and are the exclusive property of CHATEAU ROUGE.

 

Article 4.10: Conciliation & Dispute

In the event of a dispute between CHATEAU ROUGE and the BUYER, the most diligent party shall send, prior to any referral to a court, a formal notice letter detailing the grievances against the other party.

If a conciliation attempt cannot be implemented within 15 days from the date of the formal notice letter or if it fails, the most diligent party must notify the other party in writing, prior to any referral to a competent court, of the end of the conciliation period.

 

Article 4.11: Applicable Law & Competent Jurisdiction

These general terms and conditions of sale as well as the sales of CHATEAU ROUGE PRODUCTS are subject to the application of French law.
Failing conciliation, any dispute relating to the interpretation, execution, or termination of the contract concluded between CHATEAU ROUGE and the BUYER shall be under the exclusive jurisdiction of the French courts.
